Information Disclosure Policy (Whistleblowing)
TH has established a Whistleblowing Policy to address misconducts in the workplace to allow TH members or the public to report breaches of the code of conduct and/or integrity, in a structured manner and with assurance that the identity of the Whistleblower is protected and remains confidential.
Disclosure of misconduct such as fraud, corruption, serious financial misconduct and abuse of power committed by a person appointed by TH can be done through one of the following channels :-

Having made an honest disclosure, based on reasonable cause and in accordance with the procedures set out under this Policy:
- The Whistleblowers will be protected from retaliation in TH that stems directly from the disclosures they make; and
- The identity of the Whistleblower will be protected, i.e. kept confidential unless required by law or for the purpose of any proceedings instituted by TH or against TH.
The identity and personal information of the informant and the alleged offender may be disclosed to persons involved in the investigation or any other process on a “need to know” basis.
What Is To Be Revealed
A disclosure (“Disclosure”) may be made if it is related to one or more of the following misconducts committed by any person in the course of conducting business with or any affairs related to TH (“Misconduct”):
- Corruption or fraud;
- Criminal offence;
- Misuse of TH funds or assets;
- Financial irregularities or serious breaches of financial regulations in TH;
- Serious violation of the General Rules of Lembaga Tabung Haji 1983, Circulars as well as other terms and conditions for services provided from time to time to Members and Members of the Board of TH;
- An act or omission which poses a substantial and specific danger to the life, health or safety of TH Members or the public or the environment;
- Failure to comply with the provisions of Tabung Haji Act 1995;
- Failure to comply with the provisions of other Acts of Parliament if the offender willfully disregards or fails to comply with those provisions; or
- Intentionally instructing or advising a person to commit any of the above Misconducts.
Information Disclosure Content
The information to be reported must contain the following:
- Name of the Offender;
- Evidence of the alleged incident;
- Time of Occurence;
- Date of Occurence;
- Other Relevant Information;
- Supporting evidence (if any);
Anonymous Letters
In principle, TH will not entertain any disclosures without the identity of the Informant. However, such disclosures will be considered if the following criteria are met:
- The complainant provides strong supporting documents to prove the conviction;
- Such disclosures are made in regards to defects or weaknesses in the processes involved and do not involve any particular individual; or
- The disclosure was made because it has the potential to have a high and large reputational impact on TH as an organization.
Whistleblower Protection
Whistleblower will be protected under this Policy if the disclosure was made truthfully and honestly. Whistleblower Protection is provided under the Whistleblowers Protection Act 2010 (Act 711) which stipulates that identity of the Whistleblower will be protected and kept confidential.
The Whistleblower must provide his identity as follows:-
- Name;
- Identification Card No; and
- Phone No. to contact – Office/ Mobile Phone/ residential.
The Whistleblower will be notified of the disclosure findings.
Whistleblower Protection will be void if:
- The Whistleblower participates in the reported disclosures.
- The Whistleblower knowingly makes false and malicious statements.
- Disclosure of information is done dishonestly and without reasonable cause.
Disclosure Status Update
The Whistleblowers will be notified of the status of their disclosures as frequent as possible based on “Need to Know” requirements.
From Abu Sa’id al Khudri RA said, I heard the Prophet PBUH said:
مَنْ رَأَى مِنْكُمْ مُنْكَرًا فَلْيُغَيِّرْهُ بِيَدِهِ، فَإِنْ لَمْ يَسْتَطِعْ فَبِلِسَانِهِ، فَإِنْ لَمْ يَسْتَطِعْ فَبِقَلْبِهِ، وَذَلِكَ أَضْعَفُ الْإِيمَانِ
“Whosoever of you sees an evil, let him change it with his hand; and if he is not able to do so, then [let him change it] with his tongue; and if he is not able to do so, then with his heart — and that is the weakest of faith.” [Riwayat Muslim (78)]
